Q: What is a DUI?

DUI stands for Driving Under the Influence of Alcohol or Drugs. If you are charged with DUI, there are two cases against you: a criminal case and a civil case. The criminal case is filed in district or municipal court and carries the maximum punishment of a year in jail, a five thousand dollar fine and a license suspension if convicted. The civil case is filed by the Department of Licensing and involves the suspension of your license only.


Q: Is my license suspended?

Not at this point; it is in a temporary status. You should have been given a request for administrative hearing when you were stopped. If not, you can obtain this form online at: DUI Driver’s Hearing Request: http://www.dol.wa.gov/forms/525001.pdf. This form must be postmarked within 20 days of your arrest date or you will forfeit your right to this hearing. It is always a good idea to speak with an attorney about this hearing before requesting it. Your license, unless suspended for any other offense, will be good through your Department of Licensing hearing date.


Q: Will I be able to drive if my license is suspended?

You will be able to drive when your license is suspended if you apply for, and are granted, an ignition interlock license (IIL).
